A compensation mechanism for the negative balances resulting from the accounts for the months of March to June 2020 with the partial unemployment subsidies due for the months of July to December 2020 will be put in place to recover the advances received by certain companies.
This is what the Minister of Labor Dan Kersch (LSAP) proposed during the Conjuncture Committee, which agreed on the way to proceed. An operation which also aims at administrative simplification.
Concretely, each employer who has had recourse to partial unemployment will receive a detailed statement for each month concerned, whether it is for a balance still due (positive) or when the company has received from the State too large an amount. (negative). According to the press release published on Wednesday by the Ministry of Labor, Employment and the Social and Solidarity Economy, three scenarios may arise.
- In the event that the statements show a positive balance, Adem will pay the remaining balance due to the company concerned.
- In the event that the accounts show a negative balance and the company concerned has not yet proceeded with the reimbursement, this overpayment will be offset with the partial unemployment benefits due for the month of July 2020. This compensation mechanism will be implemented. in place from mid-October 2020.
- Companies that have not submitted a request for partial unemployment for the month of July and / or the previous months will have to reimburse the overpayment of the advances for the months of March to June 2020 within 30 days.
The Adem, who has just completed the treatment, has started sending the partial unemployment statements linked to the covid-19 crisis for the period from March to June 2020.
As a reminder, the government did not hesitate to generalize partial unemployment during the lockdown that paralyzed the country at the start of the health crisis last March. Of the some 860 million advances on wages already paid, the Ministry of Labor estimates that 40% could be recovered by the state coffers. That is more than 320 million euros that some of the 14,700 companies benefiting from the measure will have to repay.
