Judgment in the chocolate dispute: a competitor no longer wanted to accept that the square shape of Ritter Sport is legally protected. But Milka now lost to the Federal Court of Justice.
In a year-long legal dispute over the square packaging of Ritter Sport chocolate, the Federal Court of Justice protected the special shape as a packaging brand. The judges announced this on Thursday morning. The competitor and Milka manufacturer Mondelez has been trying for years to have the registered trademark deleted.
The BGH had to check this for the second time since mid-May. In 2016, the Federal Patent Court initially ordered the cancellation of the controversial trademark. A year later, the BGH overturned this decision and referred the procedure back to the patent judge, who rejected the application for cancellation in 2018. In contrast, Mondelez again before the BGH.
